Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between Vineyard Baggage Co., LLC, a Massachusetts limited liability company ("Vineyard Baggage Co.," "we," "us," or "our"), and the individual booking a shipment ("Customer," "you," or "your"). By completing a booking through our website, checking the acknowledgment boxes presented at checkout, or otherwise using our service, you agree to be bound by these Terms. If you do not agree to these Terms, do not book or use our service.
1. Definitions
"Shipment" means one booking, which may include one or more bags or items picked up together at a single address on a single date.
"Custody Period" means the period from the moment we take physical possession of your bag(s) at pickup until the moment we tender your bag(s) to USPS, UPS, or another common carrier for onward shipment.
"Carrier" means USPS, UPS, or any other common carrier we use to ship your bag(s) after the Custody Period ends.
"Declared Value" means the value you state a bag or its contents to be worth, if you elect an optional declared-value upgrade at booking.
2. Service Description and Scope
Vineyard Baggage Co. provides door-to-door luggage and golf bag pickup on Martha's Vineyard and shipment to a residential or business address in the contiguous United States (custom quotes available for Alaska, Hawaii, Puerto Rico, and APO/FPO addresses). We are not a common carrier, licensed freight forwarder, or insurance company. We arrange for your bags to be professionally packed, labeled, and tendered to a Carrier for transport; we do not personally transport your bags to their final destination.
3. Right to Accept, Decline, or Discontinue Service
Vineyard Baggage Co. reserves the right, in its sole discretion, to accept, decline, or discontinue service for any shipment, for any reason or no reason, including but not limited to concerns about item value, fragility, condition, prohibited or restricted contents, or the volume of items presented for a single booking. We are not obligated to accept every shipment offered to us.
4. Booking, Payment, and Pricing
4.1 Full payment is due at the time of booking via our secure online checkout. We do not accept cash, checks, or bill-later arrangements.
4.2 The price shown at checkout is all-inclusive of pickup, packing materials, carrier shipping, residential delivery, and the liability coverage described in Section 7, except for any additional fees disclosed at checkout for pickup outside our standard time window, short-notice booking, peak-season capacity, or measurement/re-weigh discrepancies. Current fee amounts for each of these are shown in your booking confirmation and on our FAQ / pricing page, which are incorporated into these Terms by reference and may be updated from time to time; the amounts disclosed to you at the time of your specific booking control for that booking.
4.3 Cancellations and changes. Our current cancellation and change policy, including applicable fees, is stated on our FAQ page and at checkout at the time of your booking, and is incorporated into these Terms by reference. That policy may be updated from time to time; the version shown to you at the time of booking controls for that booking.
4.4 Customer-caused delay. If you are not ready with your bag(s) at the start of your scheduled pickup window and this causes us to reschedule or delay shipment, a rescheduling fee applies as disclosed at checkout, in addition to standard shipping cost. If a delay is caused by our own error rather than yours, you will receive a full refund of any resulting delay fee, and we will absorb the cost of any expedited shipping needed to correct the delay.
5. Prohibited and Restricted Items
You may not ship, and must affirmatively confirm at booking that your shipment does not contain: hazardous materials, perishable items, cash or currency, jewelry, high-value electronics (including laptops, tablets, and gaming consoles), prescription medications, firearms or ammunition, or illegal substances.
Shipping a prohibited item in violation of this Section, or misrepresenting the contents of a shipment, voids the limitation of liability in Section 7 as to that shipment and constitutes a material breach of these Terms, without limiting any other remedy available to us.
6. Photo Documentation
At pickup, with you present, we photograph each bag's exterior condition. We photograph your packaged bag(s) again immediately before tendering them to the Carrier. These photographs are our — and your — primary record of your bag's condition during the Custody Period and are used to evaluate any claim under Section 7.
7. Limitation of Liability
7.1 The Cap
Vineyard Baggage Co.'s liability for loss of or damage to your bag(s) during the Custody Period is limited to a maximum of $500 per shipment, regardless of the number of bags included in that shipment, except in cases of our gross negligence or willful misconduct.
Where more than one bag in a shipment is lost or damaged, compensation is allocated in proportion to each affected bag's share of the total documented value of all affected bags in that shipment, calculated as: (documented value of the affected bag ÷ total documented value of all affected bags) × $500, not to exceed $500 in aggregate for the shipment.
Example: a shipment includes two bags with documented values of $400 and $200 (total $600). Both are lost. The $400 bag receives ($400 ÷ $600) × $500 = $333.33; the $200 bag receives ($200 ÷ $600) × $500 = $166.67 — a combined total of $500. If only one bag in a multi-bag shipment is lost or damaged, that bag receives its documented value, up to the full $500 cap.
Damage to wheels, zippers, or handles is reimbursed up to $50 per item, within the overall $500 shipment cap.
7.2 This Is Not Insurance
This limitation of liability is a contractual commitment only. It is not, and is not a substitute for, an insurance policy. Vineyard Baggage Co. does not currently carry third-party bailee's or cargo legal liability insurance covering this $500 commitment. It is backed directly by Vineyard Baggage Co., LLC's own funds.
7.3 What Is Not Covered
Regardless of the $500 amount, the following are excluded from coverage under this Section, and should not be shipped with us: electronics, fragile or temperature-sensitive items, musical instruments, jewelry and watches, precious metals, art, collectibles, antiques, cameras and recording equipment, cash, and documents.
7.4 Conditions to This Limitation
This limitation of liability applies only where you (a) have packaged your bag(s) in accordance with our stated packaging guidance, (b) submit any claim in writing within 15 days of delivery or expected delivery, and (c) provide documentation of the bag's contents and value upon our request. Failure to satisfy any of these conditions voids this limitation of liability as to the applicable claim, without limiting any other defense available to us.
7.5 Carrier Custody
Once your bag is tendered to a Carrier, our liability under this Section ends. From that point forward, the Carrier's own liability terms apply exclusively, together with any declared-value coverage you purchased under Section 7.6.
Assignment of carrier claims. You assign to Vineyard Baggage Co. any claim you may have against a Carrier for loss, damage, or delay occurring after tender, and agree not to pursue a claim against the Carrier directly. We will file and pursue any such claim on your behalf, using our own pickup and tender documentation, and will keep you informed of its status.
7.6 Optional Declared-Value Upgrade
We may offer, at our discretion and where stated at the time of booking, an optional declared-value upgrade allowing you to purchase additional coverage above the $500 cap in this Section, funded by third-party shipment insurance. Where offered and purchased, the terms of that upgrade — not the $500 cap in Section 7.1 — govern coverage up to the declared amount. This upgrade is not available for any item listed in Section 7.3.
7.7 Waiver of Subrogation
You and Vineyard Baggage Co. each waive any right of subrogation your or our respective insurers might otherwise have to recover, from the other party, amounts paid under your or our own insurance policies in connection with a shipment.
7.8 Final Settlement
Acceptance of any payment made under this Section constitutes a full and final settlement of the applicable claim, and you release Vineyard Baggage Co. from further liability with respect to that shipment.
7.9 Customer Acknowledgment
By completing a booking, you affirmatively acknowledge that you have read and understood this Section 7 in full, including that Vineyard Baggage Co. does not currently carry supplemental bailee's or cargo legal liability insurance and that the $500 cap described above is self-funded by the company directly, not by an insurer.
8. Measurement and Re-Weigh Adjustments; Payment Authorization
The weight and dimensions you declare for each item at booking are used to calculate your price. We re-measure each bag at pickup. If the actual measurement exceeds what you declared beyond the tolerance disclosed at checkout, a measurement-discrepancy fee applies (a bag that comes in under what you declared never triggers this fee), in addition to any price difference resulting from a change in size category, both as disclosed on our pricing page. By completing a booking, you authorize us to charge the payment card on file for the total shown at checkout, and for any such adjustment identified at pickup, without further authorization from you.
9. Indemnification
You agree to indemnify and hold harmless Vineyard Baggage Co., LLC, its members, and its personnel from any claim, loss, or expense (including reasonable attorney's fees) arising from your misrepresentation of a shipment's contents, your breach of these Terms, or your own packing failures.
10. Force Majeure and Assumption of Risk
Vineyard Baggage Co. is not responsible for delays or failures caused by circumstances beyond our reasonable control, including ferry cancellations, weather, road closures, or other acts of nature. You assume the risk of such delays occurring in the ordinary course of shipping to or from an island location.
11. Dispute Resolution
11.1 No arbitration; no class-action waiver. These Terms do not require arbitration and do not waive your right to bring or participate in a class action.
11.2 Governing law and venue. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be brought in the courts of Dukes County, Massachusetts, including small claims court where the amount in dispute qualifies.
11.3 Our commitment on written complaints. We respond in writing to any written customer complaint within 30 days with a concrete, good-faith resolution proposal.
12. Electronic Communications
You consent to receive booking confirmations, tracking updates, and other communications related to your shipment by email at the address you provide at booking.
13. General Provisions
13.1 Entire agreement. These Terms, together with any booking-specific confirmation and the pricing and cancellation policy pages incorporated by reference above, are the entire agreement between you and Vineyard Baggage Co. regarding your shipment.
13.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
13.3 No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
13.4 Amendment. We may update these Terms from time to time; the version in effect at the time of your booking governs that booking.
13.5 Assignment. We may assign these Terms in connection with a sale or transfer of our business. You may not assign these Terms without our written consent.
13.6 Age and authority. By booking, you represent that you are at least 18 years old and have the authority to agree to these Terms.
